Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the Merx Africa Limited platform at merx.com.ng, the Merx mobile application, and related services. This policy supplements our Terms of Service and applies to all users. Violations may result in account suspension, termination, and referral to law enforcement.
1. Permitted Use
The Merx platform is designed for legitimate commerce between buyers and sellers. You may use the Platform to:
- List and sell lawful goods and services through your Merx storefront
- Purchase goods and services from verified Merx sellers
- Conduct escrow-protected transactions as described in our Escrow Agreement
- Communicate with buyers and sellers through the Merx inbox
- Access analytics and reporting tools for your store
2. Prohibited Goods and Services
You may not list, sell, or facilitate the sale of:
- Counterfeit or replica goods, including fake designer items, pirated software, or unauthorised copies of copyrighted material
- Stolen property or goods obtained through illegal means
- Controlled substances, narcotics, or illegal drugs
- Firearms, ammunition, explosives, or other weapons
- Human organs, body parts, or any form of human trafficking
- Wildlife products or items derived from endangered species
- Pornographic or sexually exploitative material, especially involving minors
- Financial instruments, securities, or cryptocurrency without appropriate licensing
- Goods that violate Nigerian export control laws or international sanctions
- Pyramid schemes, Ponzi schemes, multi-level marketing programmes, or fraudulent investment products
- Any product or service that is illegal under the laws of the Federal Republic of Nigeria
3. Prohibited Conduct
You may not:
- Provide false or misleading information in your profile, product listings, or communications
- Create fake reviews, testimonials, or endorsements
- Manipulate pricing, transaction volumes, or analytics data
- File fraudulent disputes or abuse the escrow dispute process
- Collude with another party to defraud a buyer, seller, or Merx
- Harass, threaten, or abuse other users through the Platform or related channels
- Attempt to bypass or circumvent escrow protections, including off-platform payment solicitation for items listed with escrow
- Use automated bots, scripts, or crawlers to access or interact with the Platform without authorisation
- Exploit vulnerabilities, conduct denial-of-service attacks, or otherwise interfere with Platform operations
- Create multiple accounts to circumvent bans, restrictions, or transaction limits
- Use the Platform to launder money, finance terrorism, or engage in any form of financial crime
4. Content Standards
All content you post on the Platform, including product listings, images, descriptions, and messages, must:
- Be accurate and not misleading
- Not infringe on any third party’s intellectual property rights
- Not contain hate speech, discriminatory language, or incitement to violence
- Not include malware, phishing links, or other malicious content
- Comply with the advertising standards guidelines issued by the Advertising Regulatory Council of Nigeria (ARCON)
5. Enforcement
Merx reserves the right to investigate and take appropriate action against any user who violates this AUP. Actions may include, at our sole discretion:
- Issuing a warning
- Removing offending content or product listings
- Temporarily suspending account access
- Permanently terminating the account
- Freezing escrowed funds pending investigation
- Reporting the activity to the EFCC, Nigeria Police Force, or other relevant authorities
- Pursuing civil or criminal legal action
6. Reporting Violations
If you encounter a user or listing that violates this AUP, report it to us at abuse@merx.com.ng or through the “Report” function on the Platform. All reports are investigated and kept confidential.
